Terms of Services
This agreement ("Agreement") is between wholesale hosting service
provider Uneekz ("Uneekz") at 502-18 Panorama
Court, Etobicoke, ON, Canada and the Customer or Hosting Account
Holder ("Customer") specified in the electronic order form
annexed herein by reference ("Order"). The agreement is made
effective as of the date of the order.
The parties agree as follows:
1-Agreement
This page is here to define the rules of use related to the services
suggested of Uneekz.net. Uneekz.net sells online services, named
services. To use the services you ordered, you have to accept this TOS
(TERMS OF SERVICE). Your online order form is equivalent to your
signature. When you order that means you have fully read this page and
accepted it. That means you are totally OK with the TERMS OF SERVICE of
Uneekz.net. You agree that all the information you provided are true and
correct. At any moment, you have the right to modify the information you
gave us under your control panel. For critical information (like e-mail,
names) you have to mail the support service of Uneekz.net
(support@Uneekz.net).
2-Disagreement
If you do not agree with the TERMS OF SERVICE leave the order form
immediately. Only users that accepted the TERMS OF SERVICE have the
right to register and then get services from Uneekz.net. If you already
have an account, and you are in disagreement with our TOS (TERMS OF
SERVICE), please mail the sales service to ask for a TERMINATION of your
account. Thank you.
3-Modifications of Agreement
Uneekz.net has the right to modify the TOS at any moment. Users that
subscribed to one of Uneekz.net services will receive a mail to tell
them about any modifications of the TOS. If you don’t mail us to ask to
terminate your account, we’ll consider that you still want to maintain
your account and that you are still accepting our TOS.
4-Personnal Information
When you subscribe to one of our services, you have to provide your real
name, address and phone number. During your service period you will be
able to modify your subscriber information. When you choose to terminate
your account, we assure you that all data concerning your identity will
be deleted from our servers instantly.
5-Payments
All charges/fees related to your subscription must be paid in advance.
The service will be useable only when the payment has been made. At the
moment, we only offer PayPal payments. We guarantee that PayPal is a
secure way to pay for our services. Payments aren’t refundable. We
securely store all information related to the transaction to help
authorities in their work in the case of a fraudulent transaction.
Uneekz.net offers the user to add funds to his account at any time. In
this way, the user can order a service when he want to, or renew a
service.
6-Refunds
Uneekz.net WILL NEVER GIVE ANY REFUNDS. ALL PAYMENTS DONE ON YOUR
ACCOUNT AREN’T REFUNDABLE.
7-Resource Usage
We can not be held responsible for any packet losses, capped bandwidth
or any other matter that could affect the use of your services.
8-Guarantee of Service & Liability
Uneekz.net guarantees a reliable and fast service. We can’t be held
responsible of any damages caused by a tier on servers. We are connected
on the best American & European backbones to ensure a good service. We
do not guarantee your data. So you have to maintain your own backup.
Uneekz.net isn’t responsible of any lost data or of any attacks against
your data, or of any unauthorized access to your data. Uneekz.net isn’t
responsible of any intrusion in your personal data. The subscriber is
responsible for all such risks. We are not responsible for any lost
profits caused by your services being unavailable.
9-Illegal Use
The user is responsible for the content he stores on his hosted account.
We just provide hosting. We can not be held responsible for the content
you host. Valid complaints of any illegal content will result of the
instant termination of your account and attached services. Uneekz.net
will help authorities to resolve any problems related to your account
about illegal use. You can’t use your account to store illegal content
like : warez, porn, kiddie porn, spam resources, illegal porn,
trademarks, defamatory content, pirated software, pirated music, pirated
movies (this include all copyrighted materials all over the world),
cracks, hack scripts, loop scripts, trade secrets. YOU AREN’T ALLOWED TO
USE YOUR SERVICES TO STORE, SHARE ANY CONTENT THAT BREAK LAWS OF CANADA,
UNITED STATES OF AMERICA, IN THE STATE OF MICHIGAN & FRANCE. ANY ILLEGAL
USE WILL RESULT IN INSTANT TERMINATION OF YOUR ACCOUNT AND ATTACHED
SERVICES WITHOUT ANY POSSIBILITY OF REFUND.
10-Usage
We do not allow any kind of illegal content on our servers. We do not
allow sites that provide storage, sale, distribution, hypertext link to,
advertisement, promotion or hosting of material that is unlawful,
defamatory, obscene, harmful, threatening, harassing, or an intrusion of
privacy or publicity rights, or otherwise objectionable. We have a
tolerance equal to 0 about that. Any violations of these rules will
result in instant termination of your account and attached services
without any possibility of refund.
11-Fraud Content
If you use your services to offer or distribute any fraudulent goods,
services, schemes or promotion (i.e. : make money fast, schemes,
chain-letters, pyramid schemes), or submitting false data on any sign-up
form, contract or online application through registration, or any
fraudulent use of information obtained through your services, including,
without limitation, use of credit card number, phone numbers, emails, or
home addresses, your account will be instantly terminated without any
possibility of refund.
12-Copyright or Trademark Infringement
Use of our services to provide any sort of transmission (by email,
uploads, downloads, posting or otherwise) or storage of any material
that infringes any copyright, trademark, patent, trade secret or other
proprietary rights of any third party, including, but not limited to,
the unauthorized copying of copyrighted material, the digitalization and
distribution of photographs from magazines, books, or other copyrighted
source, and the unauthorized transmittal of copyrighted software is
TOTALLY FORBIDDEN. This sort of infringement result of an instant
termination of your account and attached without possibility of refund.
13-Privacy Policy
The privacy of our customers is very important for us. We defend
individual rights. We believe that the information of any customers is
strictly confidential. It is why we’ll never share your personal
information to any third party. All information you fill or filled in
our forms are only for our purpose. We only use this sort of information
for internal use. Only the financial information is collected by third
party we use to manage our payments (i.e. : PayPal). At any moments you
can contact us, or change by yourself the information you have provided.
You have the rights to view/modify any personal information we store

14-Security
Using your services to violate Uneekz.net, third party’s servers,
system, network security is prohibited and may result in criminal or
civil liability. We will investigate such incidents involving such
violations and cooperate with the proper law enforcement authorities if
a criminal violation is suspected on our servers. This includes without
limitation : - Viruses - Trojans Horses - Worms - Time Bombs - Cancel
Bots - Or any sort of content that may damage any system, program, data
or personal information - Any sort of hacking or unauthorized access -
Scanning - Flooding - Spamming - Spoof - Phishing - Overloading of
systems - System attacks - Unauthorized monitoring of any data/traffic
on any network We have the right to modify specifications of any
accounts on our servers that may compromise the security of our servers
or third party servers.
15-E-Mail
Spam is unauthorized on our servers. Using your plan to send mass e-mail
messages (spamming) is strictly prohibited. Sending e-mail that contains
false company information, false promotions, viruses, or malicious
e-mails is strictly prohibited. Any violation of these rules will result
on an instant termination of your account including a fee of US $500 for
damages caused by your usage. Uneekz.net is the sole arbiter as to what
constitute a violation of this rule.
16-Services
16.1-Uneekz
* Uneekz.Net is a service provided by Dedibox.fr. Uneekz.net resells the
offer from Dedibox.fr all around the world. Our goal is to provide to
anybody, anywhere an hosting account at a very low price. The added
service in the Dedibox.fr offer is our 24/7 support service (by tickets,
emails and IRC).
* We do not guarantee our delivery time. As we are subject of waiting
time from Dedibox.fr, we’ll try our best to provide as soon as possible
the ordered accounts.
* We wont offer refunds on any of Uneekz Hosting services and related
services.
* Be careful, the Uneekz services doesn’t include an automatic renew.
The customer must do it by his own.
* WE DO NOT ALLOW ANY IRC SERVICES TO BE HOSTED ON YOUR SERVER (S), ALL
FORBIDDEN CONTENTS MENTIONED RIGHT ABOVE TOO. WE AREN’T RESPONSIBLE OF
THE USE OF YOUR HOSTED ACCOUNT.
* We do not guarantee any data, you have to maintain by your own your
backups.
* We do not allow any illegal contents. All illegal use of your account
will result in an instant suspension without any refunds.
* We aren’t responsible for any bandwidth cap. You may be capped because
of overusage of your bandwidth to international destinations like
USA/CANADA/ASIA.
* You aren’t allowed to host any streaming media without mailing us
before, we need to know EXACTLY what you are streaming, and need to get
the proof you have the authorizations to stream such medias.
* You cannot resell our offered packages.
17-Laws
Our company is based in Canada, Ontario. You have to be in accord with
laws of the Canada and state of Ontario to use our services. You shall
be in accord with any applicable laws in the Canada to use our services.
You must be 18 years or older to use our services, and responsible in front of the law.
If you think you are violating Canadian laws, please leave our site, and
don’t buy our services. We are not responsible for any illegal actions
by you while using our services. The user of the services is the ONLY
RESPONSIBLE ONE of all content stored on our servers. We will cooperate
with any law enforcement if complaints against your content are made.
18-Entire Agreement
You must be in agreement with our Terms of Service before using our
services. Any violations of these Terms of Service could result in an
instant termination of your account without refund. In subscribing, you
agree with our Terms of Service.
19-Modifications
Uneekz.net may modify, at any moment, the Terms of Service. All current
customers will be informed by e-mail of any modifications of these Terms
of Service.
20-Indemnification
You agree to hold harmless and indemnify Uneekz.net, the owners and
their agents, partners, affiliates, and content partners, against any
liability for any claims and expenses, including reasonable attorney’s
fees and court costs, relating to any violation of the terms of this
Agreement, including the Terms of Service or any content placed on the
Service by you.
21-Rules
All mentioned rules apply FOR ALL OUR SERVICES.
22-Illegal Torrents
POSITIVE IDENTIFICATION OF A ACCOUNT SEEDING ILLEGAL TORRENTS WILL
RESULT IN A SEARCH OF THE HOSTED ACCOUNT.
ANY ACCOUNT FOUND HOSTING ILLEGAL TORRENTS WILL BE CANCELED WITHOUT THE
POSSIBILITY OF REFUND OR RE-ORDERING.
